Campaign for a Democratic Constitution for Kurdistan – have your say

The glorious ‘Arab Spring’ toppled some dictatorships and haunted others with the sceptre of people power. It also reverberated across Kurdistan, raising now the prospect of self-rule for Kurds in west Kurdistan and last year inspiring citizens in semi-autonomous south Kurdistan to revolt against our unjust rulers.

Following the horrors of Saddam, the Kurdistan Regional Government should be a model of democracy and good governance. Instead we have autocratic rule, frequent human rights abuses and endemic corruption strangling our society. Our natural resources are treated as the rulers’ private property. There is no real accountability. We endure a form of tribal rule masked, mainly for international consumption, by the trappings of democracy.

That is why we need a written constitution for the Kurdistan Region, as a corner stone for robust institutions, the separation of powers, the rule of law and government of, for and by the people.

Now is the time to re-open the discussion that culminated in the Kurdistan Parliament voting for a draft constitution in 2009. Nothing has happened to the draft since and we believe that – especially given recent developments – it now needs careful review and amendment. Then it should be approved by parliament and put before the people for their approval in a referendum.

We propose that a revised draft constitution should, among others, include these features:

  • Reduced role for the presidency and the election of the President by Parliament.
  • Separation of religion from the state, while firmly upholding and respecting the rights of all to their beliefs and worship.
  • Creation of unified armed forces and the abolition of private militias.
  • Natural resources to be transparently under the control of Parliament.

In association with a number of Kurdish intellectuals, politicians and journalists, KT has decided to help kick-start the process and work for a broad-based Campaign for a Democratic Constitution for Kurdistan.

We urge you, our readers, to participate in this first, consultative, phase.

Alongside the 2009 Draft Constitution we are publishing a list of proposed amendments. These have been composed by us and the Kurdistan Institute for Elections and they are meant to provide a basis for discussion. We invite you to have your say by posting comments, sending us emails and submitting articles (of 400-1500 words) which we will consider for publication.

We propose to run this consultation for one month before moving to the next phase of the campaign.

    Very good article, especially the points about the problems facing the Kurds within Iraq. It’s sad and ironic the KRG behaves as it does, but unfortunately this is what family rule and power does. It corrupts. It seems as though the Peshmerga are the private security contractors of the ruling Kurdish elite, rather than an army. This being the Middle East, it is difficult to sway an army away from its commander(s), so it would be a difficult task to persuade the Peshmerga to ditch the old boys’ club of Talabani/Barzani (more the latter). Setting up another army would be dangerous, too, as this would lead to various factions battling for power once a power vacuum is created. This is currently what is happening in Libya. The various rebel groups are now fighting for power and Libya risks splitting into three regions. The same is likely to happen in Syria. It’s there in Iraqi Kurdistan where Slemani and Hewler are split because of political differences and the war in the 1990s.

    The result is that people are afraid to do anything and accept have to accept the status quo. Meanwhile Barzani and Talabani decided that stealing from the Kurds only wasn’t enough, so now they steal from the whole of Iraq. And who’s to stop them? A very sorry and frightening state of affairs, indeed.

    Going forward inspired by the past
    Claude Smadja may be right – for the wrong reason that is, IMO. The brilliant think tanker and former director of the World Economic Forum recently had harsh words on Swiss radio – «fumisterie» – on the pathetically misguided diplomatic gesticulations in the face «unavoidable» conflict resolution by military means. Of course, he rightly pointed out that in the Near East of today, political no less than military adversaries still have a built-in and difficultly suppressable tendency to seek to «annihilate» muscularly each other, rather than looking brainly for mutually beneficial power- and interest-sharing, common ground, compromise and consensus-building.
    But my own insights gained over the last twenty years of working with Arab (Sunny & Shiite alike), Assyrian, Kurdish, Turkomen and Yezidi leaders have made me aware of real possibilities to open up the minds of these bearers of ancient cultures and traditions to new vistas and real opportunities for more mutual respect and harmonious relations among themselves and with their brethren. The third-way path thus developed since 1992 for the Mosul Vilayet (Northern Iraq: http://www.solami.com/senate.doc ) is a case in point, illustrating what might be commonly worked out and achieved by the constitutive communities themselves in and, in the event, in combination with neighboring Syria. If only foreign agendas were kept at a healthy distance, that is.
    In fact, Claude may be underestimating some of Langley’s and Washington’s Foggy Bottom and H Street wizzards’ on-going contribution to the current and dangerously evolving state of affairs in Iraq, Syria and neighboring countries. Of their tendency to act as monopoly holders, as flat Earth fellows treating the rest of the world as Wild West, and as pathological suppressors of anything related to the fore-runner of the United Nations, i.e. the League of Nations. The climax of this latter phenomenon has probably been attained when Iraq’s newly enthroned foreign minister, ignorantly mouth-piecing some H Street apprentice sorcerers, killed as «colonial stuff» the UN Security Council’s plan to integrate in its key resolution 1546 Iraq’s still fully valid and immensely useful constitutive Declaration of 1932: http://www.solami.com/a3a.htm#1932 ).
    Looking forward, some say a regionally stabilising lasting solution to the still festering open wounds of the Ottoman Empire breakup – in and around Syria – may not be found on ordinary tracks. Neither with diplomatic nor with military means. They draw inspiration from the nine-stars puzzle – requiring to connect all nine stars of the square with four straight lines without lifting the pen (www.solami.com/puzzle.htm )- whose solution cannot be found within the confines of the apparent problem:

    Thus, they advise us to look further back into history, seek common ground in Syria’s constitutive ethnic, religious and cultural communities, and eventually build on such common roots. In practice, this could amount to revisiting the genesis, objectives and results of the Lausanne Treaty of 1923. Setting their house back in order is, of course, a task nobody can lift from the shoulders of the Syrians themselves. However, more deep draught and visionary leaders of Syria’s constitutive communities might find it possible to escape the deafening war noise, to distance themselves from areas and issues of conflict, and to start reflecting among themselves and, in the event, to draw on the services of genuine friends of them. Eventually, this may lead to a follow-up conference to the memorable 1923 Lausanne Conference (www.solami.com/Syria.htm ). Whether the ultimate result of such an exercise would be a reconfiguration – some may call it federalisation – of Syria essentially along ethnic lines, a splitting up of some of Syria’s original states (www.solami.com/galbraith3.htm ), or an internationally recognisable recasting of some Near Eastern borders is not for the messenger to predict.

    I wholeheartedly support KT glorious campaign and hope every one come out and support it . The amount of short and long term damage that Barzanis and Talabanis are doing to the kurdish society is huge and the consequences would be dire should they not be stopped . People , not the US , who give legitimacy to rulers . It is time we stand up and stop this bunch of idiots turned eternal politicians and forever leaders .

    The free world should do their bit too .

    As a non-Kurd I do not feel entitled to meddle into details of this very important and qualified discussion. Yet, as a longtime friend of Kurds I welcome the proposed emphasis on the strict separation of state/civil administration and government on the one hand and religions on the other. Also the pledged tolerance towards all religious beliefs as long as they are not misused to advocate violence is essential. Therefore an introduction like “In the Name of God, the Most Gracious, the Most Merciful” may have its justification elsewhere, but not in a new Kurdish constitution ideally.

    لە ماددەی5 نووسراوە(گەلی كوردستان پێكهاتووە لە كورد، توركومان، عەرەب، كلدان، سریان ئاشووری، ئەرمەن و هاوڵاتیانی دیكەی هەرێمی كوردستان). درووست وایە ناوی پێكهاتەكانی تر بنووسرایە، نەك هەر وا بە نووسینی(و هاوڵاتیانی دیكەی هەرێمی كوردستان) لە كۆڵی خۆیانی بكەنەوە. ئەم هەڵەیە لە ماددەی6 دووبارە دەبێتەوەو نووسراوە(ئەوانی دیكە- ئەوانی دیكە كێن؟!). ئێوە دەستوور دەنووسن، نەك وتارێكی سادە(بەبێ ئەوەی لە نرخی وتار نووسیین، كەم بكەمەوە!

    لە بڕگەی1ی ماددەی19نووسراوە(كەرامەتی ئادەمیزاد پارێزراوەو رێزلێگرتن و پاراستنی ئەركی هەموو دەسەڵاتەكانی هەرێمە). ئایا ئیمڕۆ لە واقعدا كەرامەتی هەژارەكان پارێزراوە؟ ئایا بڕگەی3لەم ماددەیە لەگەل سواڵكەرو قەرەچەكان پەیڕەودەكرێ؟!

    25- سەرچاوەی نەهامەتییەكانی خەڵكی هەژار:
    ماددەی 15(هەرێمی كوردستان پشت بە سیستمی ئابووری و بازاڕی كێبڕكێی رەوا دەبەستێ لەگەل هاندان و گرتنەبەری پەرەپێدانی ئابووری لەسەر بنەمای نوێ و وەبەرهێنان، بە هەردوو رووی گشتی و تایبەتیەكەیەوە، قۆرخكردنیش بە یاسا نەبێ رێگەی پێنادرێ.)

    27- ماددەی 16لەلایەن حكومەتی هەرێم لە شاری مەندەلی بە تایبەتی پێشلكراوە!
    28- لە ماددەی 18نووسراوە(دەی سەپێنێ)، درووستەكەی(دەیسەپێنێ)یە.

    34- لەم بڕگەیە هاتووە(هەموو كەس مافی ئەوەی هەیە دەستی بە چاودێریی لەش ساخی و چارەسەریی پزیشكی رابگا، بێ لەبەرچاو گرتنی توانای خەرجییەكان). ئەگەر وابێت بۆچی گەشە بە كەرتی نەخۆشخانەی تایبەت دەدرێ؟! ئایا خزمەتكردنی پزیشكی لە كەرتی گشتی و تایبەتی وەك یەكن؟!
    35- ماددەی27 لە واقع چۆن رەنگی داوەتەوە؟
    بڕگەی1 ئەم ماددەیە لەبەر ئەم هۆیانەی خوارەوە، زۆر كورتی هێناوە، بۆ نموونە: 1- دەبێ دایكوباوكان خەرجی هاتووچووی منداڵەكانیان لە نێوان ماڵ و قوتابخانە بدەن و زۆرێك لە خێزانە هەژارەكان لەبەر دەستی كورتیاندا، دەبێ منداڵەكانیان لەبەردەم باوباران و گەرمایی بە پێ هاتووچۆ بكەن. 2- دایكوباوكان دەبێ دەفتەر و قەڵەم و جانتا و پێداویستییەكانی تر بۆ منداڵەكانیان بكڕن 3- قوتابیانی زانكۆ دەبێ بە خۆیان خەرجی لەچابدانی پەرتوك و نووسراوەكان بدەن.
    بڕگەی 2ی ئەم مادەیە لە چەندین شاروشارۆچكەی كوردستان پەیڕەو نەكراوە، بۆ نموونە وەك لە مەندەلی، سەعدیە، جەلەولا.
    بڕگەی 3ی ئەم ماددەیە وەك پێشنیار وایەو بەهیچ شێوەیەك كۆنكریت نییە.
    بڕگەی4: لە شارە گەورەكان خانەی تایبەتی بۆ سەرپەرشتی و پاراستنی ژنان دامەزراندووە، بەڵام هێشتا پێویستی بە ماندوبوونی زۆرتری هەیە.
    بڕگەی 5: حكومەت و پەرلەمان لە ئاستی عەمەلی و بە بەرچاوی گەلی كوردستان، سیستەمی ناهەقی دادەمەزرێنن كەچی ئیمزای ئەم خاڵەشیان كردووە: (هەموو شێوەیەكی جیاكاری و توندوتیژی و ناهەقی لە نێو كۆمەڵگا و قوتابخانە و خێزاندا قەدەغە دەكرێ.)
    كەواتە چ پێویستییەكمان بە بوون و مانەوەی حزبێكی شیوعی نەماوە!
    ئەگەر وابێت، ئێمە بە گوێرەی دەستوورەكەمان، مافی خۆمانە لەبەردەم دادگا سكاڵا لەسەر حكومەت تۆماربكەین. ئایا ڤیلاكانی سەر لووتكەی جیاكەی دهۆك و ڤیلاكانی رێی فڕۆكەخانەی هەولێر دامەزراندنی جیاكاری نییە لە كۆمەڵگەكەمان؟ هەر لە ئێستاوە بەرپرسەكانی پەرلەمان600000دۆلار بە ڤیلایەك دەدەن لە(گوندی ئیتالی)!
    پێدەچێت نووسەران و ئیمزاكەرانی ئەم خاڵە بە هاوڵاتیان ڕادەبوێرن!
    ئایا ئەم تێبینی و بۆچوونانە شوێنی خۆیان دەگرن؟!
